New Mexico DWI Superblitz Underway

Crackdown on drunk driving in New Mexico will last into early 2009.

Drunk DrivingNew Mexico started its annual Superblitz aimed at cracking down on motorists who are driving drunk. This year the campaign has been extended through the New Year celebration.

Law enforcement agencies across the state will be conducting random sobriety checkpoints and enhanced drunk driving patrols on Thanksgiving weekend and then every weekend in December and the first weekend in January. According to New Mexico DWI czar Rachel O’Connor, the state typically only conducts two short Superblitzes.

The winter Superblitz looking for motorists who are suspected of driving while intoxicated in New Mexico will end January 4, 2009.

Police Officer Faces Pennsylvania DUI in Philadelphia

Off-duty cop strikes another vehicle in early morning PA drunk driving offense.

PA DUI AccidentA Philadelphia police officer has been charged with driving under the influence in Pennsylvania following a two vehicle accident. Bryan Gable was driving in the Rhawnhurst area of the city around 3:40 am when he hit a van driven by a 67-year old man.

The driver of the van suffered a concussion and treated and released at a local hospital. Gable, who was off-duty at the time of the accident, was not seriously injured. He has been charged with drunk driving in Philadelphia and he could face additional charges after a review by the District Attorney. Official penalties, including suspension, could also be meted out by the Police Commission.

Gable, 21, is a one year veteran assigned to the 25th District. According to a police spokesperson, Gable has been assigned desk duty and his “police powers have been stripped.”

Woman without pants charged with Florida DUIDrunk DrivingA Bay County Sheriff’s deputy responded to reports of a vehicle driving the wrong direction and found a Bonifay woman asleep in her car with the motor running. She had a strong odor of alcohol, glassy eyes, flush face and no pants. When asked why she was not wearing pants, she replied that she was hot. When asked for her license she initially handed the trooper a cigarette, then produced her license while explaining that got had just gotten her license back from a prior DUI. After failing a field sobriety test she was charged with driving under the influence in Florida.

Showing up drunk at Pennsylvania DUI hearing earns jail time – Travis Hudson, 23, appeared at his court hearing for drunk driving in Pennsylvania disheveled and intoxicated. After a breath test showed his blood alcohol content was well above the legal limit, the judge promptly revoked bail and tossed Hatboro in jail. In addition to PA DUI charges he has now been cited for public drunkenness.

Man earns New Hampshire DWI for driving friend to DWI hearing – Edward Cooper, 50, drove his friend to the Candia courthouse for a NH drunk driving hearing. Cooper proceeded to ram the curb outside the courthouse, drawing the attention of law enforcement. Cooper now has his own hearing coming up for drunk driving.

Texas Drunk Drivers Using Hospitals to Avoid DWI

Texas emergency rooms are not required to test for intoxication during treatment.

Drunk DrivingThe emergency rooms of Texas hospitals routinely treat those involved in automobile accidents. By some estimates, half of the patients brought to ER were driving while intoxicated, yet the police are not notified and no DWI arrest is made.

Trauma doctors are not required by law to report drunk drivers. Even if the case is reported, there typically is no evidence for the prosecutor to work with as doctors are also not required to test for blood alcohol content.

There is a financial reason for not testing for alcohol, as insurance providers routinely use a 60-year old federal statute to deny coverage for injuries caused by intoxication. Instead of running the risk of not being reimbursed for services, hospitals limit their actions to their primary function of treating the injured. Doctors have also said that it is not their role to act as law enforcement.

Six states do require hospitals to report drunk drivers and eleven states have laws requiring insurance companies to pay claims for alcohol related injuries. While such measures have been proposed in the Texas State Legislature during the past three sessions, currently the state has neither provision. In the interim, motorists who have been involved with alcohol related accidents are not being charged with Texas DWI.

Dakota County Sheriff’s Deputy Nabbed for Minnesota DWI

Officer was off-duty when arrested for drunk driving in Twin Cities area.

Drunk DrivingDakota County Sheriff’s Deputy Joshua Williams was charged with driving while intoxicated in Minnesota following a traffic stop last weekend. Williams was caught speeding at 68 mph in a 55 mph zone around 2:00 am. The arresting officer saw an open bottle of beer in the vehicle and initiated a series of field sobriety tests and a breath test, both which Williams reportedly failed. Williams was arrested at the scene and booked on charges of Minnesota DWI at the Dakota County jail. His car was impounded.

Williams was involved in a deadly accident with his squad car in August 2007. He pulled out in front of a motorcycle, striking and killing the rider. In May 2008 he was convicted of careless driving. He was prohibited from driving county issued vehicles and was re-assigned to duty as a court bailiff. His license was supposed to have been suspended for one year though it was reinstated in October, just five months later. Williams also has a 1998 North Carolina DWI conviction, meaning the recent arrest could be filed as DWI second offense.

Williams has been with the county sheriff’s department since 2000. Following the drunk driving arrest he was placed on paid administrative leave, which angered the Dakota County Chief Deputy.

Khloe Kardashian Finishes DUI Probation Requirements

She faced penalties for not completing court ordered programs following arrest for California DUI.

Khloe Kardashian's DUI ProbationKhloe Kardashian, co-star of the reality television show ‘Keeping up with the Kardashians’, has reportedly finished the requirements of her probation stemming from a DUI arrest in Southern California. Khloe’s attorney spoke from a Van Nuys courtroom stating that his client had successfully completed an alcohol education program and performed duties at a local morgue. He went on to call her a “superstar”.

Kardashian was sentenced to 36 months of probation following a no-contest plea to a 2007 arrest for driving under the influence in California. She was required to complete community service and attend alcohol education classes. She failed to do both and in July of this year was ordered to re-enroll in the alcohol awareness program. Because community service was no longer an option, Kardashian was sentenced to 30 days in jail. However, due to facility overcrowding, she spent only five hours behind bars. Kardashian technically remains on probation but the judge presiding over the case has said no additional hearings are scheduled.

Khloe Kardashian frequently appears on the E! reality series chronicling the exploits of her sister Kim Kardashian. She also recently completed a second season of ‘The Celebrity Apprentice’.

Mailman Busted for Arkansas DWI

Driver of postal van was arrested for drunk driving in Van Buren.

Drunk DrivingA Van Buren mailman was charged with driving while intoxicated in Arkansas last weekend. Billy Kenneth Seabolt was driving a government postal van when he was stopped on suspicion of AR DWI. Seabolt, 56, was booked for Arkansas DWI-2 because of a 2005 conviction for drunk driving.

The Van Buren police said the mail vehicle was recovered by the US Postal Service following the DWI arrest.

Judge Dismisses Texas DWI Against Former Lawmaker Mike Krusee

Retiring republican legislator Mike Krusee avoids charge of drunk driving in Williamson County court.

Mike Krusee DWI DismissedRetiring Republican legislator Mike Krusee had his charges of misdemeanor Texas drunk driving dismissed by a judge. Judge Chuck Miller, assigned to the case as a visiting judge to the Williamson County court, found that the prosecution presented insufficient evidence.

Krusee was arrested for suspicion of driving while intoxicated in northwest Austin on April 30, 2008. He was reportedly driving erratically prior to a traffic stop and had expired vehicle registration. The officer detected alcohol and noted that Krusee's eyes were bloodshot. Krusee failed three field sobriety tests though he refused to submit to a breath test, which left the arresting officer's testimony and the dash-cam video as the only evidence in the case. Krusee's DWI defense attorney argued that his client's stumbling and field sobriety test errors may have been caused by the wind that was apparent in the video and that the videotape evidence was inconclusive for a DWI conviction. The judge agreed.

The percentage of DWI arrests in Williamson County that are dismissed is about 30%. Some of those are plead to lesser charges so a complete dismissal such as Krusee received is unusual.

In 2003, Krusee lead the effort to enact a driver responsibility program in Texas calling for stiff surcharges against those found guilty of drunk driving. It included a $1,000 charge for a first conviction of driving under the influence in Texas, and a $1,000 fee for each of three years payable to the Department of Public Safety in order to renew a driver’s license.

Utah DUI Related Fatalities Lowest In Nation

Report shows Utah has dramatically lower percentage of fatalities from drunk driving.

Drunk DrivingA report to be presented to state legislators indicates that Utah has the lowest percentage of fatalities attributable to driving under the influence. With the most recent figures show the United States average is 41%, Utah DUI accounts for 22% of road fatalities.

The report is the sixth such accounting. It indicates a slight drop in drunk-driving related fatalities from 2006 to 2007. It also shows an increase in the number of arrests for driving under the influence in Utah; up 639 arrests to a total of 15,300. The fiscal accounting period ended June 30.

Heather Locklear Formally Charged with California DUI

Actress was arrested in September for suspicion of driving under the influence in Santa Barbara.

Heather Locklear DUI ChargeThe Santa Barbara District Attorney's Office has filed a formal complaint against Heather Locklear, alleging that she was driving under the influence of a prescription drug.

Locklear was arrested on September 27 in Montecito after a paparazzo called to 911 about erratic driving. The caller later photographed Locklear's California DUI arrest. According to the arresting officer with the California Highway Patrol, Locklear was obstructing a traffic lane and appeared disoriented. While alcohol was ruled out, the actress failed a field sobriety test and drugs were suspected.

She was booked on misdemeanor charges of driving under the influence of drugs and being under the influence of a controlled substance. No alcohol or illegal narcotics were present in her blood test and the latter charge was dropped, though prescription medications were discovered. The filing of formal charges was delayed while waiting for a full investigation and the results of a toxicology test. Locklear will be formally arraigned January 26, 2009.

Locklear, 47, appeared on many television shows, including 'Dynasty', 'Melrose Place' and 'TJ Hooker'.

I have found that DUI/DWI fines are not going down at all. DUI/DWI fines are a source of income for the counties and states with mandated alcohol counseling, probation fees, drivers license surcharges and other fees.

Fines for DUI should continue to increase. The costs to our communities to arrest and prosecute these selfish individuals continue to rise. Punishments such as license suspensions and harsh fines need to be severe enough to cause us to think twice before getting behind the wheel drunk. Speak to the people whose lives have been destroyed by drunks. My son was a passenger in a car that was hit by a drunk who ran a red light. As your child leaves the house today and you caution them to "Be careful" remember it does not matter how careful your child is if there is a drunk behind the wheel on the same road. Drunk drivers are a threat to us all.

from,but,unless you're willing to "turn the page" on our freedom,civil rights and way of life as Americans and unless you're willing to sell out this great country to mindless irrational pressure groups and eventually probably find yourself saluting the chinese or the north korean flag,I think
you should reconsider your way of thinking.just ask yourself,
since when was using "fear tactics" ,imposing "harsher laws" and "severe punishment" the best way to solving problems in the UNITED STATES OF AMERICA? the solutions have to be in line with our core values and the spirit of our constitution.
we can not afford paying our freedom and civil rights as a price for the so called "safety".

Our core values in America include respect for our neighbors. Our right to live. The Constitution establishes our rights and in return, we are asked only to be law abiding citizens. Asking and expecting people to make responsible choices is not a fear tactic. The only people that fear harsher laws are the selfish individuals that feel they are above the law. The ones that put their own desire to drive drunk over the rights of the innocent person they kill. What are mindless irrational pressure groups are you so frightened of? Driving drunk is not a civil right.

We have too many people in jail period.
We encarcerate more of our population then any other civilized nation on earth.
It was merely pot, now it is alcohol. While they utilize the DUI statutes it does not matter, many are jailed merely for being found to have been drinking wether they drove or not.
The ravenous appetite of our out of control penal system will never be satisfied but only grow as more and more are fed to it.As thathappens more and more unreasonable laws and law enforcement. Given the stories coming out now about the crimes being perpetrated by law enforcement officials in thier quest to feed this lion it should not be long.
We have become a nation of unreasonable incarceration. the war on drugs could not keep the system fed nor will these unreasonable DUI laws. They will only wreck innocent lives in the name of saving life while the death rate on our highways continues climbing unabated. If they really wanted to decrease highway fatailities they would fix the roads. And stop cramming so many onto so small a driving area. When the number of cars goes up and the roadway area does not then the danger/death rate goes up. Putting people in jail does nothing to change this equation.
The devestation of the war on drugs and DUI statutes will not go on as they are today for long. As more and more families are kicked to the curb by the real consequences of these barbarian methods more will rise up until there are so many that jails will finally and mercifully be closed down and the lions that fed on the carnage sent packing.
the real victims are not only those in prison, but their families as well who suffered the economic consequences and emotional trauma inflicted upon them by a system that allowed the real animals to incarcerate good people for the real crime of having normal human faults.
This will certainly happen and when it does we should be prepared to deal with the economic re-patriation of the real victims of these laws.
